Law Court finds for town in charter revision suit

In a July 2, 2024 decision, the Maine Supreme Judicial Court found in favor of the Town of Bar Harbor in an appeal of a 2022 lower court decision nullifying changes to the Town charter approved by the voters in 2020 because they were submitted to the voters in separate questions.

"We conclude that the Town acted lawfully in submitting the charter commission's proposals to the voters in the form of separate questions and that none of the claimed procedural irregularities nullifies the vote," the justices wrote. "We therefore vacate the judgment and remand for the court to enter a judgment for the Town on Good's complaint."

This means all the changes enacted in November 2020 remain valid.
