Fayetteville ordinance limiting application, background check fees effective Jan. 13

FAYETTEVILLE, Ark. - A new ordinance limiting the fees prospective tenants are required to pay for rental applications and background checks takes effect in Fayetteville on Monday, Jan. 13, 2025.

In October, the Fayetteville City Council passed Ordinance 6800 which limits landlords and property managers within the city to a maximum combined total charge of $40 for rental applications and background checks.

The maximum amount that can be charged for an application fee is $20 if no background check is performed. Additionally, if a landlord or property manager collects a background check fee but does not perform such a check, the ordinance requires said fee to be returned to the prospective tenant.

Per the ordinance, the goals of these limitations include promoting equitable housing practices and enhancing access to affordable housing options while allowing landlords and property managers to recover the actual costs incurred when screening potential applicants.

Use of a shared application system is encouraged as a method to help landlords save time and prospective tenants to save money.
