Project Description:

The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve the application for a renewal and modification of State Pollutant Discharge Elimination System (SPDES) Permit NY0002984, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

Vanderbilt Minerals, LLC - Gouverneur Mineral Division No. 1 Mill is an industrial facility that processes wollastonite ore. Wastewater consists of 0.090 MGD of cooling water and air conditioner condensate, and is discharged via outfall 002 to an unnamed tributary of Turnpike Creek, a Class D water.

The following changes to the permit are proposed: remove decommissioned outfall 001; increase the monthly average flow limitation to 0.090 MGD; reduce the effluent limitation for total suspended solids from a daily maximum of 50 mg/L to a daily maximum of 40 mg/L and add a new monthly average effluent limitation of 20 mg/L; reduce the effluent limitation for total zinc from 0.53 mg/L to 0.47 mg/L; remove effluent limitations and monitoring requirements for total lead; add a new daily maximum effluent limitation for oil & grease of 15 mg/L; add a new requirement to develop and implement a mercury minimization plan; add a schedule of submittals; update permittee contact information; update permit pages to reflect current format, definitions, nomenclature, and latest general conditions. As a result of the EBPS full technical review, a new five-year permit term is proposed.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0002984.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
