Availability for Comment: Draft State Pollutant Discharge Elimination System (SPDES) General Permit for Private, Commercial and Institutional Discharges to Groundwater of Treated Sanitary Sewage GP-0-25-002
This notice announces the availability, beginning November 13, 2024, of the draft SPDES General Permit for Private, Commercial and Institutional Discharges to Groundwater of Treated Sanitary Sewage (draft GP-0-25-002) and its draft Fact Sheet for public comment.
Background:
The New York State Department of Environmental Conservation (NYS DEC) proposes to renew the SPDES General Permit for Private, Commercial and Institutional Discharges to Groundwater of Treated Sanitary Sewage as GP-0-25-002. Upon its anticipated effective date, GP-0-25-002 will replace the previous general permit, GP-0-15-001, which expires on May 10, 2025.
Draft GP-0-25-002 is in accordance with the New York State Environmental Conservation Law (ECL), Article 17, titles 7 and 8, as well as Article 70. Pursuant to ECL 17-0817(1) and 6 New York Codes, Rules and Regulations (NYCRR) 750-1.15, GP-0-25-002 is a ten (10) year permit. This project is an Unlisted Action under the State Environmental Quality Review Act. A Negative Declaration is on file for draft GP-0-25-002. A coordinated review was not performed in accordance with 6 NYCRR Part 617.6(b)(4).
Changes:
Numerous changes were made in draft GP-0-25-002 compared to GP-0-20-001, which are identified and explained in the draft Fact Sheet. One notable change is that owners with coverage under GP-0-15-001 will not automatically gain coverage under draft GP-0-25-002. Instead, those owners must follow the requirements in Part II.A. of draft GP-0-25-002 to maintain coverage.
