City granted temporary restraining order against property performing unpermitted work

On August 9, 2024, the District Court of Maryland for Frederick County granted the City of Frederick's motion for a temporary restraining order against Ryan Weinstein and two associated LLCs, each defendant having an interest in the property located at 103 East Seventh Street. The order enjoins the defendants from engaging in any further execution of work on such property or any city-owned property. The City has also filed a complaint for temporary restraining order and preliminary and permanent injunctive relief. That complaint asks the court to issue an order that, in addition to preventing the defendants from engaging in any further work on the property without valid permits, requires them to remove or correct the work that has already been done unlawfully, and also prohibits illegal use or occupancy of the property. A hearing on the complaint has been scheduled for October 25, 2024.

"The City of Frederick is committed to ensuring that all properties in the city are maintained to their highest and best use," said Mayor Michael O'Connor. "The City has rules and regulations for property owners, and if the rules are not followed, The City owes it to the residents in our community to take all available action."
