RNC Files Application in SCOTUS

WASHINGTON -Today, the RNC took a critical legal step in ensuring Americans decide American elections. Along with the Arizona Legislature, we filed an emergency application for a stay pending appeal in the Supreme Court in our Arizona documentary proof of citizenship case. If successful, this will allow Arizona to enforce proof of citizenship requirements for this presidential election.

RNC Chairman Michael Whatley stated: "Requiring proof of citizenship is common sense and fundamental to preserving the integrity of our elections - especially in our country's most important presidential election. This application in the Supreme Court is pivotal to ensuring that Arizonans' votes are not cancelled by non-citizens. Non-citizen voting is illegal and we are taking every possible action to ensure American elections are decided solely by Americans."

Background:

  • In 2022, the Arizona Legislature passed critical election integrity legislation (HB 2492 and HB 2243). Among other things, the law requires voters to provide documentary proof of citizenship to be eligible to vote in presidential elections or cast a mail ballot in any election. The law also requires counties to conduct citizenship verification checks and remove non-citizens from the rolls.
  • The RNC successfully defended the law's citizenship verification provisions in federal court. However, the court prevented Arizona from enforcing the documentary proof of citizenship requirements.
  • It is critical that only citizens vote in our elections, especially by mail and in the upcoming presidential election. We appealed the ruling to the 9th Circuit. We filed this application for a stay in the US Supreme Court to allow Arizona to enforce its proof of citizenship requirements in the 2024 election.
