Public Hearing Notice: Development Code Amendment

CITY OF MURRIETA
NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Council of the City of Murrieta on Tuesday, September 3, 2024, at 6:00 p.m, or a time soon thereafter, at City Hall, 1 Town Square, Murrieta, CA 92562, to consider the following matter:

DEVELOPMENT CODE AMENDMENT (MCA-2023-00003): A request by the City of Murrieta to amend Chapter 16.18 for "Hazardous Materials Storage" for updated terminology and updated notification protocols with underground and above ground storage tanks; updates to Solid Waste/Recyclable Materials Storage to fix an existing error and renumbering related tables to facilitate easier referencing; amend Chapter 16.22 for the use of barbed and razor wire due to safety concerns/aesthetics with some exceptions; amend Chapter 16.30 for Construction Noise as Saturdays are missing operating hours, amend to Chapter 16.34 to address parking quantities for agricultural and similar uses; amend Chapter 16.38 to address Signs to address some existing minor typos, updates table numbering/naming, and adding the "Innovation Zone" to the Business Park sign standards; provide updates to Chapter 16.44 for Residential Accessory Structures to address existing setback inconsistencies and to provide additional clarity on what is applicable; provide updates for vehicles dealerships to provide additional clarify, provide updates to wedding/event facilities to correct a 4.5 acre versus 5-acre inconsistency; provide updates to Chapter 16.46 for the removal of the Planning Commission report to City Council by the City Clerk's office, provide updates to Medicinal Cannabis Delivery Service to add large medical centers as a sensitive use; provide updates to Chapters 16.90 and 16.98 to streamline the processing of Final Maps under the City Engineer's authority; and provide updates to Chapter 16.110 to add a Gross Floor Area definition which is currently lacking and miscellaneous updates to Chapter 16.

Relatedly, provide updates to the Municipal Code for updates under Chapters 1.04, 8.20, and 8.28 for enforcement, as it relates to the removal of refuse and provides for abatement procedures; provide updates to Chapter 1.26 to correct an existing timeline as it relates to the appeal of administrative citations, and provide updates to Chapter 10.44 for removal of the Estate Residential 2 (ER-2) Zone exception for the parking on paved surfaces due to the smaller lot configuration within that zone.

Please note that on June 26, 2024, the City of Murrieta Planning Commission provided two modifications to the draft Ordinance at that time which was subsequently recommended for approval by this decision body. This included the removal of the proposed restrictions on vehicular-mounted signs that were under consideration for Section 16.60.050, subsection D., and the removal of the proposed parameters for slaughtering and rendering activities which were under consideration for Section 16.44.040.

Environmental Determination: Categorically exempt pursuant to CEQA Guidelines Section ยง15061(b)(3) as the activity is covered by the "common sense" exemption and that CEQA applies only to projects that have the potential for causing a significant effect on the environment. The minor amendments inclusive of this amendment fall within the parameters of this CEQA Section and would be within the framework of the City's General Plan and Zoning parameters.

At the public hearing, the City Council will consider all oral and written statements made or filed by any interested person at or before the conclusion of said hearing. If you wish to challenge the update of the project in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Murrieta City Clerk at 1 Town Square, Murrieta, CA 92562 and by email at [email protected]. Written comments may also be submitted at the public hearing.
