The BDI sees no need for the introduction of new regulation in the form of a European AI Liability Directive. An excessive liability framework could drive many AI providers and deployers to over-compliance with the AI Act, which could have a negative impact on innovation and AI development in Europe. Through new legal concepts, such as requests of potential claimants and considerable changes to the principles of evidence, the AI Liability Directive would have a significant impact on national civil laws.
