New York Supreme Court Denies Motion to Dismiss by Gov. Hochul on the Congestion Pricing Block Lawsuit

The case advances and the defendants have until October 15 to respond to the claims; The Congestion Pricing Program signed into law in 2019 to fund public transportation improvements, improve air quality, reduce traffic, and reduce greenhouse gas emissions

Today, the New York State Supreme Court rejected the motion to dismiss filed by Governor Hochul and other Respondents. Today's decision means the challenge to the Governor's block of the Congestion Pricing program will go forward. The defendants have until October 15 to respond to the lawsuit filedon July 25, 2024 by Earthjustice on behalf of Riders Alliance, the New York City Environmental Justice Alliance, and the Sierra Club which details the violations of New York's transformative Climate Leadership and Community Protection Act (CLCPA) and the New York State Constitution's Article 1, Section 19, the "Environmental Right" provision.

The following statement is attributed to Dror Ladin, Senior Attorney at Earthjustice:

"Today was an important victory for New Yorkers and the planet. The Governor tried to shut the courthouse doors to New Yorkers who are concerned about the air we breathe, the cars crowding our streets, our underfunded public transit, and the future of our planet. The judge rejected the Governor's effort to shield her disastrous decision to block congestion pricing and confirmed that her decisions are not above the law."
