ITAR Interim Final Rule Creates New Exemption for Certain Countries

In a Federal Register Notice (FRN) published on August 20, 2024, the Department of State announced an interim final rule that would amend the International Traffic in Arms Regulations (ITAR) to create a new exemption for certain "defense articles and defense services exports to Australia, the United Kingdom, and Canada."

The interim final rule also adds a list of articles and services excluded from eligibility for transfer under the new exemption and adds to the scope of the exemption for "intra-company, intra-organization, and intra-governmental transfers" for certain authorized dual nationals.

This rule went into effect on September 1, 2024.

The Department of State is seeking additional public comments on the interim final rule, with the deadline for submission being November 18, 2024.
