BakerHostetler Team Authors Successful Amicus Brief Supporting Enforcement of ICSID Awards

A BakerHostetler team led by Partners Carlos Ramos-Mrosovsky and Paul Levine and including Associates James East, Mary Kate Wagner and Jillian Timko, represented the International Scholars, a group of some of the world's preeminent scholars and practitioners of investor-state arbitration and public international law, authoring a successful amici curiae in three cases that were before the U.S. Court of Appeals for the District of Columbia Circuit: NextEra Energy Global Holdings BV v. Kingdom of Spain (No. 23-7031), 9REN Holdings SARL v. Kingdom of Spain (No. 23-7032) and Ioan Micula et al v. Government of Romania (No. 23-7008).

The cases questioned whether intra-EU International Centre for Settlement of Investment Disputes (ICSID) awards (those resulting from an arbitration brought by an investor from one EU member state against another EU member state) will be enforceable under the ICSID Convention of the U.S. The brief argued that enforcing the ICSID awards at issue was required pursuant to the U.S.'s own obligations under the ICSID Convention.
