AND NOTICE TO PUBLIC OF REQUEST FOR RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Michigan State Housing Development Authority.
On or about 12/09/2024 the Michigan State Housing Development Authority (MSHDA) will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Project Based Voucher (PBV) funds under Section 8 (o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o)(13)) as amended, to undertake the project known as Royal Oak Cottages I for the purpose of:
MSHDA intends to award Royal Oak Township Limited Dividend Housing Association LLC up to 7 units of Project Based Voucher (PBV) rental assistance in support of Royal Oak Cottages I. Royal Oak Cottages I will be located at 21322 Woodside Ave., Ferndale, MI 48220. Royal Oak Cottages I is a proposed new construction, 28-unit single-family home affordable housing development targeted for families seeking affordable, high-quality housing in the Royal Oak Township area. The Development will be a scattered site, with boundaries defined by Northend Avenue to the north, Mitchelldale to the east, Eight Mile Road to the south, and Myers Road to the west. The 28 homes will consist of 3-bedrooms and 2 full bathrooms each, in a 2-story configuration. The rear entry to each home can be modified to allow for ADA accommodations. All units target households earning below 30%, 40%, 50%, or 60% of the area median income (AMI). Fifteen (15) of the 30%-AMI units will receive Project Based Vouchers, eight (8) from the Local PHA and seven (7) from MSHDA. The MSHDA PBVs will be serving the homeless and special needs population.

MSHDA also gives notice that it has been determined that the release of funds for the above development will not constitute an action significantly affecting the quality of the human environment and accordingly MSHDA has decided not to prepare an Environmental Impact Statement (EIS) under the National Environmental Policy Act of 1969 (NEPA, 42 USC 4321) because no significant environmental adverse impacts or hazards were identified in the course of the environmental review. An Environmental Review Record for the proposed development is on file at MSHDA, 735 E. Michigan, Lansing, Michigan 48912. The records are available for public examination and copying upon request between the hours of 8 a.m. and 5 p.m., Monday through Friday. Public Comments
Any individual, group, or agency may submit written comments on the ERR to MSHDA. All comments received by 12/06/2024 will be considered by MSHDA prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
Release of Funds (Vouchers)
MSHDA certifies to HUD that MSHDA and Anthony Lentych, MSHDA'sChief Housing Investment Officer, Certifying Officer, consents to accept the jurisdiction of Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Royal Oak Township Limited Dividend Housing Association LLC to use the PBV assistance.
Objections to Release of Funds
HUD will accept objections to its release of funds and MSHDA certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of MSHDA; (b) MSHDA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) a grant recipient or other participants in the project have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Detroit Field Office at [email protected].
