Virginia Man Arrested for Assaulting Law Enforcement and Other Charges During Jan. 6 Capitol Breach

WASHINGTON - A Virginia man was arrested today for assaulting law enforcement and other charges related to his alleged conduct during the Jan. 6, 2021, breach of the U.S. Capitol. His alleged actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election.

Anatoliy Anatolievich Lutsik, 32, of Sterling, Virginia, is charged in a criminal complaint filed in the District of Columbia with felony charges of assaulting, resisting, or impeding certain officers and civil disorder.

In addition to the felonies, Lutsik is charged with misdemeanor offenses of entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, engaging in physical violence in a restricted building or grounds, disorderly conduct in a capitol building, act of physical violence in the Capitol grounds or buildings, and parading, demonstrating, or picketing in a Capitol building.

Lutsik was arrested today in Sterling, and he will make his initial appearance in the District of Columbia.

According to court documents, Lutsik was identified among a crowd of rioters on the West Front of the U.S. Capitol grounds on Jan. 6, 2021. Throughout the day on Capitol grounds, Lutsik's alleged conduct included picking up a fire extinguisher and spraying police officers, pulling on a bike rack that was utilized as a police barrier, and entering the U.S. Capitol.

At approximately 2:07 p.m., while on the West Front of the Capitol, it is alleged that Lutsik picked up a fire extinguisher and sprayed law enforcement officers and, only a few minutes later, Lutsik allegedly pulled a bike rack barrier away from police officers who were using the barrier to prevent rioters from advancing further onto Capitol grounds.

It is alleged that Lutsik entered the Capitol building at approximately 2:36 p.m. via the Upper West Terrace Door and made his way to the Rotunda, Statuary Hall, and toward the House of Representatives Chamber. At about 2:38 p.m., Lutsik walked into Statuary Hall and, according to an open-source video, appeared to make a video call and stated, "Hey ma, I'm in the Senate. I told y'all I'd make something of myself."

Lutsik exited the building at approximately 2:45 p.m.

This case is being prosecuted by the U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney's Office for the Eastern District of Virginia.

The case is being investigated by the FBI's Washington Field Offices. Valuable assistance was provided by the U.S. Capitol Police and the Metropolitan Police Department.

In the 43 months since Jan. 6, 2021, more than 1,488 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including nearly 550 individuals charged with assaulting or impeding law enforcement, a felony. The investigation remains ongoing.
