Banta Praises U.S. Supreme Court’s Decision to Limit Government Overreach

HARRISBURG - Rep. Jake Banta (R-Erie) praised Friday's Loper Bright Enterprises v. Raimodo, a decision by the U.S. Supreme Court to overturn the 1984 decision in Chevron v. National Resources Defense Council.

The court reversed a 40-year-old precedent which allowed federal agencies to define their own authority. The so-called Chevron Doctrine created a slippery slope for unelected federal bureaucrats to leverage power in crafting regulations on major aspects of daily American life, such as the workplace and health care.

"The overturning of the Chevron Doctrine represents a new day in preventing government overreach in our nation," Banta said. "Chevron led to an oversized federal government ruled by bureaucrats, not elected officials. This decision makes it clear our governments, both federal and state, must be for and by the people."

In May of this year, Banta introduced legislation to rein in the regulatory overreach in Pennsylvania's administrative agencies, similar to the instances which led to overturning the Chevron decision.

House Bill 2298 would prevent Pennsylvania's executive agencies from re-interpreting statutes enacted by the General Assembly and restore the proper separation of powers between the legislative and executive branches. This is a significant step which can be taken to limit government oversight and overregulation.

House Bill 2298 has been referred to the House State Government Committee for review.
