The Environmental Protection Agency (EPA) has finalized its herbicide strategy, introducing significant changes to how herbicides will be labeled in the future. We break down all the details in this story.
Earlier this year, the U.S. Department of Labor (DOL) issued a new set of rules focused on farm workers. Some of the most concerning provisions of the proposed rule included:
Overall, DOL's proposed rules would make a burdensome H-2A program even more complicated for all employers, especially small family farms. However, on August 26, in Kansas, et al. vs. U.S. Department of Labor, a judge in the U.S. District Court for the Southern District of Georgia preliminarily enjoined the Farmworker Protection Rule in certain states. Those states are Georgia, Kansas, South Carolina, Arkansas, Florida, Idaho, Indiana, Iowa, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, Tennessee, Texas, and Virginia. Miles Berry Farm and members of Georgia Fruit and Vegetable Growers Association are also protected from enforcement of the rule. On August 28, DOL announced a delay in updating the FLAG system in the Office of Foreign Labor Certification in order to reassess in light of the court's decision. The system was scheduled to update relevant H-2A job order and application forms associated with the new rule. Per DOL, this delay will happen until further notice.

The overweight permit exemption allows farmers to exceed the legal weight limit on loads by up to 15% from field to farm storage, field to market or from stockpile or farm storage to market or factory, if travel is within 70 miles.
