EPA Releases Final Herbicide Strategy, Restricting Herbicide Use Upon Renewed Label

DOL Delays Implementation of "Worker Protection" Rule

Earlier this year, the U.S. Department of Labor (DOL) issued a new set of rules focused on farm workers. Some of the most concerning provisions of the proposed rule included:

  • Removing the 14-day grace period to adjust wage rates for workers.
  • Making it more difficult to manage a workforce by creating a six-part set of criteria to terminate an employee.
  • Holding farmers responsible for violations committed by others (e.g., farm labor contractors, recruiters, attorneys, etc.).
  • Violating privacy by being forced to provide farmworker information to labor organizations upon request.
  • Reducing the amount of time employers have to defend themselves from accusations of wrongdoing.
  • Requiring farmers to allow labor organizations to visit their farms uninvited.

Overall, DOL's proposed rules would make a burdensome H-2A program even more complicated for all employers, especially small family farms. However, on August 26, in Kansas, et al. vs. U.S. Department of Labor, a judge in the U.S. District Court for the Southern District of Georgia preliminarily enjoined the Farmworker Protection Rule in certain states. Those states are Georgia, Kansas, South Carolina, Arkansas, Florida, Idaho, Indiana, Iowa, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, Tennessee, Texas, and Virginia. Miles Berry Farm and members of Georgia Fruit and Vegetable Growers Association are also protected from enforcement of the rule. On August 28, DOL announced a delay in updating the FLAG system in the Office of Foreign Labor Certification in order to reassess in light of the court's decision. The system was scheduled to update relevant H-2A job order and application forms associated with the new rule. Per DOL, this delay will happen until further notice.

The overweight permit exemption allows farmers to exceed the legal weight limit on loads by up to 15% from field to farm storage, field to market or from stockpile or farm storage to market or factory, if travel is within 70 miles. 26th Annual Golf Classic was a Hole in One for Ag in the Classroom!

The 26th annual Nebraska Farm Bureau Foundation Golf Classic was a striking success! The event raised over $50,000 that will support the AITC mission. Golfers from across Nebraska supported the fundraiser for Nebraska Agriculture in the Classroom program, which helps students understand the importance of agriculture in their daily lives.
