ADL 422229 Public & Charitable Lease

Proposed Lease - ADL 422229

The United States Army Corp of Engineers (USACE) has applied to the Department of Natural Resources (DNR), Division of Mining, Land & Water (DMLW), Northern Regional Land Office (NRO) to lease approximately 67 acres to install research equipment for monitoring permafrost changes and drainage diversion structures within Section 6 of the Fairbanks Meridian, Township 001 North, Range 001 East.

The DMLW has written a preliminary finding and decision under AS 38.05.035(a), Written Finding for the Disposal of State Resources, proposing to issue a 25-year public and charitable lease to USACE.

Proposed Mineral Oder - MO 1288

Mineral Order (MO) 1288 would replace existing MCO 12 and would close the area within ADL 422229 as well as adjacent areas in sections 5 and 6 to new mineral entry. The MO proposal is described in more detail in the "Mineral Orders" section of the Preliminary Decision, as well as in the attached draft Commissioner's Administrative Finding.

MO 1288 Legal Description: The NW ¼ SE ¼ and the N ½ SW ¼ of Section 5 within Township 001 North, Range 001 East, Fairbanks Meridian, Alaska, according to the survey plat approved by the United States Department of the Interior, General Land Office on January 16, 1914, containing 120 acres, more or less.

AND

Government Lots 1, 8, 9, 10, and 11, the SE ¼ NE 1/4, the N ½ SE ¼, and the SW ¼ SE ¼ of Section 6 within Township 001 North, Range 001 East, Fairbanks Meridian, Alaska, according to the survey plat approved by the United States Department of Interior, General Land Office on January 16, 1914 and the supplemental survey plat accepted by the United States Department of the Interior, Bureau of Land Management on August 5, 1970, containing 305 acres, more or less.

Altogether containing 425 acres, more or less.

Public notice for the related action is being conducted concurrently.

Public Notice

The public is invited to comment on the proposed lease. The Northern Regional Land Office (NRO) must receive, in writing, any comments, objections, or expressions of interest no later than 5:00 PM on July 29, 2024. Written comments should be submitted to DNR, DMLW, NRO at 3700 Airport Way, Fairbanks, AK 99709, or to [email protected]. Haley Evans can also be contacted for further information at 907-451-2806. Additional copies of the decision may be obtained by NRO upon request. Interested parties have the right to comment during the public notice period and the commenters who are aggrieved by the final finding and decision will have the right to appeal it. To be able to appeal the final finding and decision, a person must provide written comments during this comment period. A copy of the final finding and decision will be sent to any person who comments during the comment period and will include an explanation of the appeal process.

If public comment in response to this notice indicates the need for significant change in the decision, additional public notice will be given. If no significant change is required, the decision, including any minor changes, will be issued as the final decision.

DEADLINE FOR WRITTEN COMMENTS:

Written comments must be received in writing by the DMLW, Lands Section on or before 5:00 p.m. on July 29, 2024, to ensure consideration.
