ANACOM approves draft regulation on number portability

ANACOM approved, on 16 September 2024, a draft regulation on number portability, applicable to companies subject to number portability obligations.

Following the publication of Law No 16/2022https://www.anacom.pt/render.jsp?contentId=1737530, of 16 August, approving the Electronic Communications Law (2022 ECL) and repealing Law No 5/2004https://www.anacom.pt/render.jsp?contentId=975162, of 10 February (2004 ECL), the Portability Regulationhttps://www.anacom.pt/render.jsp?categoryId=333120(Regulation No 58/2005, of 18 August, and subsequent amendments) must be reviewed in order to take account of the rules now established in the 2022 ECL, whereby the provisions of the Portability Regulation adopted under the 2004 ECL, which are not incompatible with the 2022 ECL, will generally remain in force until their repeal in accordance with paragraph 2 of article 10 of Law No 16/2022.

In this Draft Portability Regulation, it has therefore been decided to maintain most of the provisions of Regulation No 58/2005 of 18 August in its current wording (provided for in the 2004 ECL), which, being compatible with the 2022 ECL, remain necessary and appropriate to ensure that number portability between companies is effective and to guarantee continuity of service provision to end users, without prejudice, of course, to the necessary amendments and/or adaptations to some of these provisions and the non-adoption of others, as detailed in the explanatory note.

This draft regulation, which is now available, will be published in Series II of the Official Gazette and, from that date, there will be a period of 30 working days for contributions to be submitted in writing and in Portuguese, preferably by e-mail to [email protected]mailto:[email protected].
