Deme Offshore US LLC - coasting trade licence

Application by Deme Offshore US LLC, pursuant to the Coasting Trade Act, SC 1992, c 31 (Act), for a licence

Deme Offshore US LLC applied, through its representative, to the Minister of Public Safety and Emergency Preparedness (Minister), for a licence to use the Plantijngracht, a heavy lift ship registered in the Netherlands, to load and transport up to 5 transition pieces and 1 anode cage tower from the Atlantic Canada Bulk Terminal at the Port of Sydney, Nova Scotia, and offload at the Port of Sheet Harbour, Nova Scotia. The activity will start on August 8, 2024, and will end on August 31, 2024.

To support the licensing process, the Canadian Transportation Agency (Agency) must determine, under section 8 of the Act, whether a suitable Canadian ship is available to provide the service.

Agency staff gave notice of the application to the Canadian marine industry, and no Canadian ships were offered.

On July 8, 2024, International Longshoremen's Association objected to the application but did not offer any suitable Canadian ship or Canadian non-duty paid ship to perform the activity described in the application.

Section 3.1 of the Guidelines for Coasting Trade Licence Applications states, in part, that if an offeror objects to an application, that objection must include an offer of a ship in order to be considered as part of the pleadings. If the objection does not include an offer of a ship, pleadings will not be opened, and the application will be considered uncontested.

As no Canadian ship has been offered, the Agency finds that, pursuant to subsection 8(1) of the Act, there is no suitable Canadian ship or Canadian non duty paid ship available to perform the proposed activity described in the application.

The Agency provides this Determination to the Minister.
