Request for Public Comment on Proposed Amendments to Local Bankruptcy Rules and Forms

The United States Bankruptcy Court for the Southern District of California, having considered comments and suggestions provided by its Local Rules Advisory Committee, proposes new rule 1007-8 and amendments to Local Bankruptcy Rules 1006-3; 2002-3; 2004-1; 9013-7; 7016-10; 7026-1; 7041-3; 3015-2; 3015-6; 9013-4; 7069; and Administrative Procedures 3.1. Public comments concerning these amendments may be submitted by October 4, 2024, via email to [email protected] (link sends e-mail) or by mail to the Court address below. Please include your name, firm name (if any), email address, and phone number with all submissions.

In addition, the following amended and new forms will be made effective December 1, 2024:

• CSD 1027 - Notice of Motion for Exemption and Opportunity for Hearing re: Credit Counseling
• CSD 1170 - Notice of Modified Chapter 13 Plan Filed Before Confirmation
• CSD 3057 - Request for Issuance of Writ of Execution
• CSD 3057A - New form Declaration in Support of Request for Issuance of Writ of Execution
• CSD 3058 - Writ of Execution
• Official Form B 103B - Application for Waiver of Chapter 7 Filing Fee Waived (begin using Official Form instead of CSD 1020 on December 1, 2024)

Also, the Court has terminated use of two CSD Forms and is currently using these Director's Forms:

• Director's Form B 2540 - Subpoena for Rule 2004 Examination
• Director's Form B 2570 - Subpoena to Produce Documents, Information, or Objects or to Permit Inspection of Premises in a Bankruptcy Case (or Adversary Proceeding)
