New York State Implementation Plan, New York Metropolitan Area, Fine Particulate Matter, 1997 Annual And 2006 24-Hour Standards, Limited Maintenance Plan For 2024-2034, July 2024

Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) plans to submit a State Implementation Plan (SIP) Revision to the United States Environmental Protection Agency (US EPA) for approval. Pursuant to sections 175A(a) and (b) of the Clean Air Act (CAA), two 10-year maintenance plans are required for areas that have been redesignated to attainment from nonattainment (maintenance areas) for a National Ambient Air Quality Standard (NAAQS).

NYS DEC's first 10 year maintenance plan for fine particulate matter (PM2.5) for the New York portion of the New York-N. New Jersey-Long Island (NY-NJ-CT) area (NYMA) was submitted to the US EPA on June 27, 2013 and US EPA approved it on April 18, 2014.

In October 2022, US EPA issued guidance (EPA-420-B-22-044) that allows for states with existing maintenance areas to submit what is referred to as a Limited Maintenance Plan (LMP) that relies on actual monitoring data to demonstrate that the area will have a very low (less than ten percent) probability of exceeding the NAAQS in the future.

The proposed SIP revision will include NYS DEC's second 10 year maintenance plan, a LMP, for NYMA that demonstrates continued attainment of the 1997 Annual and 2006 24-hr NAAQS for PM2.5 through 2034. The New York counties included in the maintenance area are Bronx, Kings, Nassau, New York, Orange, Queens, Richmond, Rockland, Suffolk, and Westchester.

NYS DEC is providing a 30-day period to comment on the LMP and proposed SIP revision, or to request a hearing. Written comments or hearing requests should be submitted by August 30, 2024, to the contact listed below.
