Legal Action Fund Application Deadline Rapidly Approaching

Applications for the next round of financial awards from NAHB's Legal Action Fund is Sept. 10 for consideration at the NAHB Fall Leadership Meeting.

NAHB's Legal Action Fund helps defray litigation costs for builders, developers and state/local associations involved in cases of national significance to the housing industry or that have the potential for meaningful impact on housing industry issues.

At the 2024 Spring Leadership Meeting, the NAHB Legal Action Committee recommended financial assistance through the Legal Action Fund for two cases, which the Board approved at its meeting. Each case addresses an issue of national significance or a question that poses a common problem for NAHB members.

  • The Metropolitan Builders Association of Greater Milwaukee received support in its challenge against the city of Delafield's handling of impact fees. Instead of maintaining separate interest-bearing accounts, the city has been spending the money on debt services.
  • NAHB members the Wilson family received a grant for their challenge to a denial of an application to rezone their property from agricultural to residential, despite the area being designated for future residential development in the county's Comprehensive Plan. Moreover, the county had already installed sewer facilities and granted an easement for the property to connect to this system. In addition to funding, the Board recommended NAHB participate as an amicus in this matter if the appeal goes up to the state Supreme Court.

NAHB will next consider Legal Action Fund applications at its Fall Leadership Meeting in San Antonio in October. Applications are due Tuesday, Sept.10.
