Notice of Intent

Each state and indian tribal organization (ITO) which plans to operate the Summer EBT program must notify the Secretary by January 1 of each year of its intent to do so. For FY 2024, states and ITOs must submit a notice of intent (NOI) affirming that the CN state agency, the SNAP state agency, and/or any other public agency partners, as appropriate, are committed to administering the Summer EBT Program in the subsequent summer.

This notice will not bind the state or ITO to administer the program in 2024 should unforeseen challenges present an absolute barrier to implementation. For states, the NOI must name the Summer EBT coordinating agency and any partner agencies and include the authorized signatory for both agencies. For ITOs, the NOI must name the administering agency and include the authorized signatory for that agency.

Submission of an NOI is prerequisite for receiving FY24 administrative funds. States and ITOs may use the NOI attached or submit a notice that provides substantially the same information.

Affirmative Statement

Each state, territory, and indian tribal organization (ITO) which plans to operate the Summer EBT program must notify the Secretary by January 1 of each year of its intent to do so. For FY 2024, states, territories and ITOs must also clearly attest that non-federal funds have been identified and are available to meet the 50 percent match requirement. Initial FY 2024 administrative funds will not be released until both the notice of intent and the affirmative statement have been provided.

States, territories and ITOs may use the provided affirmative statement or submit a notice that provides substantially the same information. Every state agency or ITO in direct receipt of an initial Summer EBT administrative grant must submit an affirmative statement to their respective FNS regional office.

Interim Plan for Operations & Management (iPOM)

Each state and indian tribal organization (ITO) that intends to administer the Summer EBT program beginning in 2024 must submit to the FNS regional office, as soon as is practicable, an Interim Plan for Operations and Management (iPOM) for the Summer EBT program in fiscal year 2024.

Final Plan for Operations & Management (POM)

Each state and tribal organization that intends to administer the Summer EBT program beginning in 2024 must submit to their respective FNS regional office a final POM not later than Feb. 15, 2024.

In states with multiple Summer EBT agencies, the coordinating Summer EBT agency is the primary point of contact for the Summer EBT program and is responsible for the complete and timely submission of the POM. However, the POM must be developed in cooperation with all state Summer EBT agencies and be reflective of the plans and administrative funding needs of both. For tribes, the administering agency is responsible for its program's POM. For the purposes of this document, the term 'Summer EBT agency' includes all administering agencies within a state or tribe unless otherwise specified.

The final POM must:

1. Address all the requirements in this template, and
2. Be approved by FNS before the Summer EBT agency may draw federal food benefit funds for the fiscal year.
