Notice of Legislative Hearing and Issues Conference

Nolen Property - Suzanne Nolen applied to the New York State Department of Environmental Conservation NYS DEC) for a freshwater wetlands permit to construct a 2,800 square foot single family dwelling, an on-site well, and a driveway on 8.12 ± acres of vacant land (a portion of tax map ID 218.-1-30.111, along the south side of Cramer road) that is currently zoned Residential (R-1) by the Town of Malta, resulting in the disturbance on 0.19 acres of the regulated adjacent area of a Class I Freshwater Wetland (R-45). NYS DEC staff determined that the application was complete on February 26, 2024. The NYS DEC denied the permit by letter dated May 1, 2024. NYS DEC staff determined that the proposed project failed to satisfy the standards for issuance of a freshwater wetlands permit (see 6 NYCRR 663.5[e]).

A legislative hearing pursuant to 6 NYCRR Part 624 to hear and receive unsworn comments from the public will be held on September 10, 2024, at 10:00 a.m., at Lansing Engineering, 2452 NYS Route 9, Suite 301 (third floor), Malta, NY 12020. This location is reasonably accessible to persons with a mobility impairment.

A pre-adjudicatory issues conference pursuant to 6 NYCRR Part 624 will be conducted immediately following the legislative hearing.

Written comments concerning the permit must be postmarked by September 12, 2024, and electronic comments must be received by 5:00 p.m. on September 12, 2024.

All petitions requesting party status to participate at an adjudicatory hearing must be received at NYS DEC's Office of Hearings and Mediation services no later than 5:00 p.m. on August 27, 2024.

A statement of issues from the Applicant must be received no later than 5:00 p.m. on August 28, 2024.
