Sixth Circuit Affirms Denial of Preliminary Injunction Motion in Title IX Case

Taft represented the University of Cincinnati (UC) in a Title IX case in the Southern District of Ohio. In this case, a now-former UC student was expelled from the school. After the expulsion, the former student sued UC in federal court alleging, among other things, that UC had violated his procedural due process rights. The former student sought a preliminary injunction prohibiting UC from imposing the expulsion.

After discovery, briefing, and an oral argument handled by Taft attorney Jada Colon, the U.S. District Court for the S.D. of Ohio denied the motion for a preliminary injunction, finding that the former student could not demonstrate a likelihood of success on the merits of his claim. The former student appealed and the Sixth Circuit upheld the decision.
