CITY STATEMENT ON TUP FOR FOURTH OF JULY EVENT AT NOBU

The City has received a number of inquiries about whether a private event will be held at Nobu restaurant in Malibu on July 4. While Nobu applied for a temporary use permit (TUP) to hold such an event, they failed to provide required information, and comply with conditions related to parking, traffic, and their circulation plan. As a result, the proposed event is not authorized to proceed. While Nobu may operate as usual, it may not hold the proposed event.

The City is aware of the traffic and public safety impacts that last year's unpermitted Fourth of July event at Nobu had on the community. It is for this reason, among others, that the parking, traffic and circulation issues were a focus of the review of the proposed TUP. Nobu is aware that they may not proceed with their event, and the City has also taken several actions, and put plans in place, to prevent or respond to any unpermitted event that may take place on July 4 at Nobu or any other location in the City:

  • The City and Malibu-Lost Hills Sheriff's Station (LASD) have informed Nobu management that they cannot hold this event, and that holding an unpermitted event would subject them to Code enforcement actions and penalties, and would also jeopardize their Conditional Use Permit which is needed to operate their restaurant.
  • Nobu agreed to pay for a traffic safety officer on site on July 4, 3:00 PM to 11:00 PM, to prevent and address any impacts to traffic flow or traffic safety. This officer is in addition to the elevated enforcement that LASD provides to Malibu on the July Fourth holiday that includes two additional traffic officers.
  • A City Code Enforcement officer will be working on July 4th and monitoring Nobu and other businesses to ensure compliance and will be in direct contact with Nobu management. If Nobu holds an event, or if they (or any venue) appear to be exceeding capacity limits, Code Enforcement will report the incident to the Fire Marshal and request the Fire Marshall shut down such events if they are exceeding their mandated capacity. City staff are not able to forcibly shut down an event themselves.
  • Code Enforcement has directed Nobu to take down all advertisements for the event.

Unrelated to the above, the City will also be providing enhanced parking enforcement on July 4 and will be monitoring known trouble spots throughout the day.
