State Police Troop C DWI arrests 6/28- 7/5

Press Release

On June 28, 2024, at approximately 11:41 a.m., New York State Police at Oneonta arrested Shawn P. Kelley, age 39 of Jefferson, NY for the misdemeanor of Driving While Intoxicated. While on State Highway 23 in the town of Davenport, a Trooper observed a vehicle make vehicle and traffic violations. While interviewing Kelley, the trooper smelled an odor of an alcoholic beverage, in addition to other characteristics associated with impairment. After performing Standardized Field Sobriety Tests, Kelley was arrested. His reportable B.A.C was .14%. Kelley was processed and issued appearance tickets to the Davenport Town Court on July 9, 2024, then turned over to a sober third party.

On June 28, 2024, at approximately 2:42 p.m., New York State Police at Homer arrested Everett W. Stone, age 39 of Pitcher, NY for the felonies of Aggravated Unlicensed Operation in the first degree, and Driving While Impaired by Drugs (with a previous conviction within 10 years) and the misdemeanor of Criminal Possession of a Controlled Substance in the seventh degree. A Trooper was dispatched to check on a driver near the corner of Hawley Woods Road and Telephone Road in the town of Taylor. The Trooper located Stone unconscious and slumped over the wheel of a running vehicle. A Trooper and a Sheriff's Deputy were able to wake Stone who displayed characteristics of impairment. After performing Standardized Field Sobriety Tests poorly, Stone was arrested. He was additionally found in possession of suspected drugs. He was processed and issued appearance tickets, then turned over to a sober third party.

On June 28, 2024, at approximately 9:55 p.m., New York State Police at Sidney arrested James W. Poole, age 42 of Laurens, NY for the Class "E" felony of Aggravated Driving While Intoxicated with Child as Passenger (Leandra's Law). Troopers on Oneida Street in the town of Oneonta observed vehicle and traffic infractions and initiated a traffic stop. While interviewing Poole, Troopers smelled an odor of an alcoholic beverage. Troopers also observed a toddler in the vehicle. After performing Standardized Field Sobriety Tests, Poole was arrested. His reportable B.A.C was .11%. Poole was issued appearance then turned over to a Deputy from Schoharie County for an active warrant.

On June 29, 2024, at approximately New York State Police at Sidney arrested Cody K. Masiello, age 25 of Oneonta, NY for the misdemeanor of Driving While Intoxicated. Troopers observed a vehicle with vehicle and traffic infractions while on Market Street in the city of Oneonta. While interviewing Masiello, Troopers detected an odor of an alcoholic beverage and other characteristics associated with impairment. After performing Standardized Field Sobriety Tests poorly, Masiello was arrested. His reportable B.A.C was .10%. He was issued appearance tickets to the Oneonta City Court on July 18, 2024, then turned over to a sober third party.

On June 29, 2024, at approximately 2:08 a.m., New York State Police at Sidney arrested Mitchell P. Murphy, age 34 of Sidney Center, NY for the misdemeanor of Driving While Intoxicated. Troopers on County Route 39 in the town of Afton observed a vehicle traveling at a very low rate of speed in a posted 55 mph zone and wanted to make sure the driver of the vehicle was okay. While interviewing the driver, Troopers detected an odor of an alcoholic beverage. After failing Standardized Field Sobriety Tests, Murphy was arrested. His reportable B.A.C was .08%. Murphy was issued appearance tickets to the Bainbridge Town Court on July 15, 2024, then turned over to a sober third party.

On June 29, 2024, at approximately 5:30 a.m., New York State Police at Margaretville arrested John C. Trahan, age 34 of Roxbury, NY for the misdemeanor of Driving While Intoxicated. While on State Highway 30 in the town of Roxbury, Troopers observed a vehicle fail to stop at a stop sign on Becker Avenue. A traffic stop was initiated, and Troopers smelled an odor of an alcoholic beverage. After performing Standardized Field Sobriety Tests poorly, Trahan was arrested. His reportable B.A.C was .08%. He was processed and issued appearance tickets to the Roxbury Town Court on August 7, 2024, then turned over to a sober third party.

On June 29, 2024, at approximately 10:45 p.m., New York State Police at Deposit arrested Thomas L. Jacobson, age 72 of Philadelphia, PA for the misdemeanors of Driving While Intoxicated and Reckless Driving. Troopers received a radio transmission that a vehicle was traveling the wrong way on State Route 17. Troopers located the vehicle, traveling eastbound in the westbound lanes. Troopers attempted to flag down the driver from the opposite lanes but were unable to gain his attention. The vehicle ultimately stopped near mile marker 274 in the town of Sanford when another vehicle blocked the roadway. After performing Standardized Field Sobriety Tests poorly, Jacobsen was arrested. His reportable B.A.C was .17%. He was issued appearance tickets to the Sanford Town Court on August 2, 2024.

On June 30, 2024, at approximately 12:02 a.m., New York State Police at Homer arrested Jacob J. Lieb, age 21 of Cincinnatus, NY for the misdemeanor of Driving While Intoxicated. Troopers were dispatched to the intersection of Telephone Road and Kiwanis Road in Cincinnatus for a crash. Troopers found a pick-up truck in the embankment with Lieb trapped inside. Lieb was extricate through a window by members of the McGraw Fire Department and treated by TLC ambulance for abrasions. Troopers observed an odor of an alcoholic beverage and after an investigation arrested Lieb. He was processed and transported to the Cortland County Correctional Facility for arraignment.

On June 30, 2024, at approximately 4:00 a.m., New York State Police at Binghamton arrested Dyshay Holton, age 30 of Binghamton, NY for the misdemeanor of Driving While Intoxicated. A Trooper observed a vehicle on Upper Court Street and observed a vehicle and traffic violations and initiated a traffic stop on Colesville Road. The Trooper observed characteristics associated with alcohol impairment. After performing Standardized Field Sobriety Tests poorly, Holton was arrested. His reportable B.A.C was .09%. Holton was processed and issued appearance tickets to the Kirkwood Town Court on August 7, 2024.

On June 30, 2024, at approximately 6:44 p.m., New York State Police at Marathon arrested James M. Oostdyk, age 41 of Oswego, NY for the misdemeanor of Driving While Intoxicated. Troopers received a radio transmission from Cortland County 911 that a pick-up truck was failing to maintain a lane while traveling north on Interstate 81. Troopers spotted the described vehicle near mile marker 45 in the town of Virgil and also observed vehicle and traffic infractions. They initiated a traffic stop and observed characteristics associated with alcohol impairment. He was arrested and issued appearance tickets to the Virgil Town Court on August 13, 2024, then turned over to a sober third party.

On June 30, 2024, at approximately 8:04 p.m., New York State Police at Ithaca arrested Zachary R. Hughes, age 31 of Cortland, NY for the misdemeanor of Driving While Intoxicated. Hughes entered a DWI Sobriety Checkpoint that was set up on Main Street just off the exit 12 (Homer) connector in the town of Cortlandville. A Trooper smelled an odor of an alcoholic beverage. After performing Standardized Field Sobriety Tests poorly, he was arrested. Hughes's reportable B.A.C was .13%. Hughes was issued appearance tickets to the Cortlandville Town Court on July 29, 2024, then turned over to a sober third party.

On June 30, 2024, at approximately 9:01 p.m., New York State Police at Oneonta arrested Victor H. Eckler, age 44 of Cobleskill, NY for the class "E" felony of Driving While Intoxicated (with a previous conviction within 10 years). Troopers observed a vehicle on State Highway 7 in the town of Oneonta that they observed to have a suspended registration and also uninspected. They initiated a traffic stop at Stewarts on Oneida Street. Troopers observed Eckler displaying characteristic associated with alcohol impairment. After performing Standardized Field Sobriety Tests poorly, Eckler was arrested. He issued appearance tickets to the Oneonta Town Court on July 18, 2024.

On June 30, 2024, at approximately 10:26 p.m., New York State Police at Homer arrested Dominic M. Mitchell, age 22 of Marathon, NY for the misdemeanor of Driving While Intoxicated. A Trooper initiated a traffic stop after observing a vehicle and traffic violation while on East Main Street in the village of Homer. The Trooper smelled an odor of an alcoholic beverage and was asked to perform Standardized Field Sobriety Tests. Mitchell was ultimately arrested. His reportable B.A.C was .17%. He was issued appearance tickets to the Marathon Town Court for July 11, 2024, then turned over to a sober third party.

On June 30, 2024, at approximately 10:41 p.m., New York State Police at Homer arrested James W. Postma 2nd, age 39 of Homer, NY for the misdemeanor of Driving While Intoxicated. Potsma entered a DWI Sobriety Checkpoint that was set up on Main Street just off the exit 12 (Homer) connector in the town of Cortlandville. A Trooper observed characteristics associated with impairment and Postma was asked to perform Standardized Field Sobriety Tests. After an investigation, he was arrested and his reportable B.A.C was .09%. He was issued appearance tickets to the Cortlandville Town Court on August 5, 2024.

On July 1, 2024, at approximately 2:11 p.m., New York State Police at Deposit arrested Mitchell O. Moniz, age 70 of Cincinnatus, NY for the misdemeanor of Aggravated Driving While Intoxicated. Troopers were dispatched to County Route 28 in the town of Sanford to check the welfare of a man in a vehicle. Troopers located Moniz in his vehicle and displaying characteristics associated with impairment. After an investigation, Moniz was arrested. His reportable B.A.C was .28%. He was processed and issued appearance tickets to the Sanford Town Court on August 2, 2024.

On July 2, 2024, at approximately 12:18 a.m., New York State Police at Ithaca arrested Hailie E. Mayo, age 22 of Ithaca, NY for the class "E" felony of Driving While Intoxicated (with a previous conviction within 10 years). Troopers initiated a traffic stop on Ashbury Road in the town of Freeville after observing the vehicle cross over a solid double yellow line. Troopers smelled an odor of an alcoholic beverage and performed Standardized Field Sobriety Tests. Mayo was arrested. She was processed then turned over to the Tompkins County Correctional Facility for arraignment.

On July 3, 2024, New York State Police at Binghamton arrested Nathan T. Lee, age 27 of Whitney Point, NY for the misdemeanor of Driving While Intoxicated. Lee entered a DWI Sobriety check point on the Interstate 81 off ramp from exit 6 when a Trooper observed characteristics associated with impairment. Lee performed Standardized Field Sobriety Tests poorly and was arrested. He was processed and issued appearance tickets to the Chenango Town Court on July 24, 2024, then turned over to a sober third party.

On July 3, 2024, at approximately 10:59 p.m., New York State Police at Ithaca arrested Carla M. Baudrons, age 36 of Interlaken, NY for the misdemeanor of Driving While Intoxicated. A Trooper initiated a traffic stop after observing Baudrons speeding while on East Main Street in the village of Trumansburg. The Trooper smelled an odor of an alcoholic beverage. Baudrons performed Standardized Field Sobriety Tests poorly and was arrested. Her reportable B.A.C was .12%. Baudrons was issued appearance tickets to the Ulysses Town Court on July 23, 2024, then turned over to a sober third party.

On July 3, 2024, at approximately 11:39 p.m., New York State Police at Ithaca arrested Joseph R. Lovejoy, age 43 of Lansing, NY for the misdemeanor of Driving While Intoxicated. A Trooper observed a vehicle and traffic violation while on Auburn Road in the town of Lansing. The Trooper initiated a traffic stop and observed characteristics associated with impairment. After performing Standardized Field Sobriety Tests poorly, Lovejoy was arrested. He was issued appearance tickets to the Lansing Town Court and turned over to a sober third party.

On July 4, 2024, at approximately 1:25 a.m., New York State Police at Sidney arrested Dyllon J. Nuernberg, age 33 of Las Vegas, NV for the misdemeanor of Driving While Intoxicated. Troopers on State Highway 205 in the town of Oneonta observed a vehicle travel over the solid double yellow line and speeding after turning onto State Highway 23. Troopers initiated a traffic stop and smelled an odor of an alcoholic beverage. After performing Standardized Field Sobriety Tests poorly, Nuernberg was arrested. His reportable B.A.C was .10%. He was processed and issued appearance tickets, then turned over to a sober third party.

On July 4, 2024, at approximately 4:07 p.m., New York State Police at Homer arrested Richard E. Allison, age 40 of Syracuse, NY for the misdemeanor of Driving While Intoxicated. Troopers were dispatched to a welfare check. Witnesses reported that a man was leaving Footie's Freeze on McLean Road in the town of Cortandville and was driving toward State Route 281 and might be possibly intoxicated. Trooper received another radio transmission from another witness stating that the vehicle was stopped and the male was urinating in a bush in front of Visionworks on State Route 281. Troopers located Allison and detected an odor of an alcoholic beverage coming from his breath. Allison performed Standardized Field Sobriety Tests poorly and was arrested. His reportable B.A.C was .17%. Allison was issued appearance tickets to the Cortlandville Town Court on August 12, 2024.

On July 5, 2024, at approximately 4:30 a.m., New York State Police at Ithaca arrested Steven M. Dubose, age 32 of Ithaca, NY for the misdemeanor of Driving While Intoxicated. Troopers on State Route 13 in Ithaca observed a vehicle traveling at a high rate of speed and initiated a traffic stop. As Troopers were approaching the vehicle, the observed the driver and passenger switching places in the vehicle. While interviewing Dubose, the Troopers smelled an odor of an alcoholic beverage. After performing Standardized Field Sobriety Tests poorly, he was arrested. His reportable B.A.C was .15%. Dubose was issued appearance tickets to the Ithaca City Court on July 24, 2024.
