Advisory Opinions

Request Received

Advisory Opinion Request 2024-07 (Team Graham) On July 5, the Commission made public an advisory opinion request from Team Graham, Inc. The requestor, the principal campaign committee of Senator Lindsey Graham, asks whether it may participate in a joint fundraising committee that also includes Sen. Graham's leadership PAC, an independent expenditure-only political committee, and the National Republican Senatorial Committee. The Commission will accept written comments on the request during the 10-day period following publication of the request (no later than July 15) and must issue a response no later than 60 days after the receipt of the complete request, that is, by Sept. 3, 2024.

COMPLAINANT: Jeffrey T. Eager
RESPONDENTS: Val Hoyle for Congress and Holly Giarraputo, in her official capacity as treasurer (the Committee); Valerie Hoyle; Rosa Cazares; and Aaron Mitchell
SUBJECT: The complaint alleged that Hoyle and the Committee received cash contributions totaling $5,800 from Cazares and Mitchell without promptly returning the amount over $100 to each contributor. Hoyle was a 2022 candidate for Oregon's 4th Congressional District.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the matter.

Litigation

Campaign Legal Center, et al. v. FEC (Case No. 23-3163) On June 28, the Commission filed a Reply in Support of its Cross-Motion for Summary Judgment in the U.S. District Court for the District of Columbia.

CREW v. FEC (Case No. 22-0035) On July 2, Plaintiffs filed a Motion for Summary Judgment or Default Judgment and Opposition to the Commission's Motion for Voluntary Remand in the U.S. District Court for the District of Columbia.

FEC v. Rivera (Case No. 22-11437) On July 1, the U.S. Court of Appeals for the Eleventh Circuit issued a Per Curiam Opinion vacating the U.S. District Court for the Southern District of Florida's grant of summary judgment and subsequent final judgment in favor of the Commission and remanded the case for further proceedings.

Outreach

On July 1, the Commission issued the Statistical Summary of 15-Month Campaign Activity of the 2023-2024 Election Cycle.

Public disclosure

On July 5, the Office of the Inspector General made public the Audit Report of the Federal Election Commission's Equal Employment Opportunity and Diversity, Equity, Inclusion, Accessibility Programs for Fiscal Year 2023.

Election Dates. The Commission has posted 2024 Presidential and Congressional Primary Dates, which are subject to change.

Contribution Limits. In addition to the current limits, the Commission has posted an archive of contribution limits that were in effect going back to the 1975-1976 election cycles.

The Presidential Election Campaign Fund Tax Checkoff Chart provides information on balance of the Fund, monthly deposits into the Fund reported by the Department of the Treasury, payments from the Fund as certified by the FEC, and participation rates of taxpayers as reported by the Internal Revenue Service. Other election-related resources

Videos on protecting U.S. elections. The FBI's Protected Voices initiative provides videos designed to help political campaigns protect themselves from foreign influence. The 2019 videos offer guidance on ransomware, business email compromise, supply chain, social media literacy, and foreign influence operations. Other videos, released in 2018, include cyber hygiene topics such as social engineering, patching, router hardening, and app and browser safety.
