Buffalo Man Sentenced for Rape

Acting Erie County District Attorney Michael J. Keane announces that 25-year-old Tamaury Love of Buffalo was sentenced before Erie County Court Judge Susan Eagan to 12 years in prison followed by 15 years of post-release supervision. Love will be required to register as a sex offender upon his release.

During the early morning hours of Sunday, March 13, 2022, the defendant forcibly engaged in sexual intercourse with the victim while armed with a knife at a residence in the City of Buffalo. The defendant was later arrested after he was linked to the crime through DNA evidence.

Love pleaded guilty to one count of Rape in the First Degree (Class "B" violent felony) on May 1, 2024. The defendant pleaded guilty to the charge in full satisfaction of the indictment.

The defendant committed the rape while pending sentence in diversion court in a burglary case. On July 20, 2018, the defendant burglarized a business on the 3100 block of Bailey Avenue. Love pleaded guilty to one count of Burglary in the Third Degree (Class "D" felony) before Judge Eagan in December 2018. The defendant, who was 19-years-old at the time of the crime, was permitted to enter a judicial diversion court program. If he successfully completed the program, he would have been permitted to withdraw his plea to the felony charge and enter guilty plea to a misdemeanor.

Prosecutors moved to terminate the defendant from the diversion program after his indictment in the rape case and citing numerous past violations of the program prior to his arrest, which were brought to the attention of the Court. Love was terminated from the judicial diversion court program. For the felony burglary charge, he received an indeterminate sentence of 2 1/3 to 7 years in prison, which will be sentenced concurrently to his sentence on the rape conviction.

The defendant was previously sentenced to a one-year conditional discharge in another criminal matter before he was identified as the suspect in the rape case. On Thursday, April 16, 2020, at approximately 10:08 p.m., the defendant knowingly entered and remained unlawfully inside of the victim's residence in the City of Buffalo. While inside of the residence, the defendant damaged items in the bathroom and kitchen and spit on the walls and countertops.

On Wednesday, May 18, 2022, Love pleaded guilty to one count of Criminal Trespass in the Second Degree (Class "A" misdemeanor). He was sentenced to the one-year conditional discharge in August 2022. Following his arrest in the sexual assault case, prosecutors pursued a Violation of Conditional Discharge. Judge Eagan ruled that the defendant violated the conditional discharge. He was re-sentenced to 364 days in jail, which will be served concurrently to his sentence on the other two cases.

Acting DA Keane commends members of the Buffalo Police Department and the Special Victims Unit for their work in these investigations.

The sexual assault case was prosecuted by Assistant Chief Gina M. Gramaglia of the Special Victims/Domestic Violence Bureau. The burglary and criminal mischief cases were prosecuted by Assistant District Attorney Daniel Morris of the Felony Trials Bureau and Assistant District Attorney Hilarie N. Henry of the Special Victims/Domestic Violence Bureau.
