Project Description:

Applicant proposes to construct up to 13 remaining Best Management Practices (BMPs) and associated infrastructure within the New Creek watershed of Staten Island to complete work previously authorized under NYSDEC Permit #2-6404-01113/00006. The proposed work will manage stormwater through a combination of collection sewers and BMPs that would function with existing wetlands to create and integrated drainage plan and construction of outfalls. The BMPs would provide extended detention, velocity attenuation and wetland benefits and functions. The New Creek Watershed covers approximately 2,249 acres extending from approximately Ocean Terrace to Father Capodanno Blvd, bounded by New Dorp Lane and Seaview Avenue. The project site is located within NYSDEC regulated Tidal Wetlands, Freshwater Wetlands NA 5, NA 9, and NA 12.

State Environmental Quality Review (SEQR) Determination:

A final environmental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: NYC Dept of Environmental Protection

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 10, 2024.
