Requested Action
The applicant is requesting a special exception from the Unified Land Development Code, Article II, Division 3, Section 2.10 Land use Conditions, condition A40, to reduce the required setback of 100 feet to adjacent property to the east, and reduce the open space/vegetative buffer width on both sides of the property.

Background
The applicant is proposing to reduce the side yard setback from 100 feet to 15 feet on the eastern property boundary; and reduce the open space/vegetative buffer on both sides of the property. Condition A40 in the Unified Land Development Code (ULDC) states that "The minimum building setback shall be a 100 feet. Within this setback, a 50-foot open space and a 50-foot vegetative buffer shall be provided."
