BISMARCK - Attorney General Drew Wrigley today joined a coalition of 50 states and territories announcing two significant settlements and cooperation agreements with Heritage Pharmaceuticals and Apotex totaling $49.1 million to resolve allegations that both companies engaged in widespread, long-running conspiracies to artificially inflate and manipulate prices, reduce competition, and unreasonably restrain trade for numerous generic prescription drugs.

Consumers who bought certain generic prescription drugs in the United States between January 1, 2010 and December 31, 2018, could be eligible for money under the settlements.

The $10 million settlement with Heritage Pharmaceuticals will be filed today in the United States District Court for the District of Connecticut. A settlement with Apotex for $39.1 million is contingent upon obtaining signatures from all necessary states and territories and will be finalized and filed in the near future. Both companies have agreed to cooperate in the ongoing multistate litigations against 30 corporate defendants and 25 individual executives. Both companies have further agreed to a series of internal reforms to ensure fair competition and compliance with antitrust laws.

"These Settlements represent a big step forward in our concerted effort to return money to consumers who have overpaid for their medications because of the interconnected web of collusion and conspiracies in the generic drug industry," Wrigley said.

The settlements are the first two settlement and cooperation agreements with corporate defendants in the continuing generic drug price-fixing litigation where a large coalition of states and territories prepare for the first trial to be held in U.S. District Court in Hartford, Connecticut. The litigation is comprised of three antitrust complaints involving more than 195 generic drugs.
