Project Description:

The applicant requests a variance to the 40,000 square foot minimum lot size provision for properties serviced by onsite sanitary systems for the proposal to subdivide an existing 20,400 square foot parcel into two parcels each having an area of 10,200 square feet. The proposed southern lot is developed with a single-family dwelling and the existing sanitary system will be upgraded to an innovative/alternative onsite wastewater treatment system (I/A OWTS). Future development of the proposed northern lot would include installation of an I/A OWTS. The area of each of the proposed lots are larger than the average lot size occurring within 500 feet of the subject property and the applicant has approval to transfer a parcel on Johns Neck Road in Shirley to Brookhaven Town for open space preservation. The subject property borders East Walk on the west side, Lighthouse Promenade on the north side, and Bayberry Walk on the east side, and is in the Village of Saltaire, Town of Islip, Suffolk County Tax # 503-4-2-65.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
