Martin Hackborn was convicted of one violation under the Environmental Protection Act (EPA), fined $5,000 plus a victim fine surcharge of $1,250 and given six months to pay.

Martin Hackborn is a director of 2366352 Ontario Ltd., which operates as Deerfield Excavating and Trucking.

In July 2020, the ministry issued an Order to Mr. Hackborn and the company, requiring the removal of waste materials that had been deposited at a site in North Dumfries.

The deposited waste materials at the site were identified as foundry sand wastes, a by-product residue created from industrial processes that typically contain soluble chemicals and other chemical binders.

Following a request for ministry review of the Order, a Director's Order was issued to Mr. Hackborn and the company in August 2020.

The Director's Order required Mr. Hackborn to remove all waste from the site using an authorized waste hauler by September 2020.

Between April 2022 and April 2023, the ministry confirmed that the waste materials were still present at the site and had not been removed by a licensed waste hauler.

The ministry's Environmental Investigations and Enforcement Branch investigated and laid charges which resulted in the conviction.
