Agenda posted for Aug. 8 stakeholder meeting

• Item 1: New draft rule for operating agreements between distillers and nonresident sellers. The draft rule implements sections 14.10 and 37.011 of the Alcoholic Beverage Code as added by the 88th Legislature in Senate Bill 60.
• Item 2: Revisions to Rule 45.2 (Definitions) to incorporate the definition for distilled spirits in section 1.04(3) of the Code. New draft rules 45.28 (Standards of Fill for Distilled Spirits) and 45.29 (Standards of Fill for Wine) to allow the container sizes and standards of fill authorized by the Alcohol and Tobacco Tax and Trade Bureau (TTB).
• Item 3: Revisions to Rule 41.12 (Compliance Reporting by License and Permit Holders) to increase the reporting period from 90 days to 180 days.
• Item 4: Amendments to Marketing Practices Advisory 019 (MPA019): Private Club Advertisement. The original advisory was published in 2006 to address acceptable methods of advertisements by private clubs in partially wet areas. The draft amended advisory proposed for discussion is renamed Authorized Advertising for Private Clubs and has been amended to provide clarity on outdoor advertising practices by holders of a private club permit.

Draft advisory MPA019 will be published in the Texas Register on Aug. 2. It is TABC's intent to receive comments on the advisory for up to 30 days following publication. Email comments to [email protected]. Following this comment period, the agency may update the draft advisory on the TABC website. Notice will be provided through industry email notifications.
