The Supreme Court for now declined to block a Biden administration rule that would impose harsh emissions rules on power plants. CEI energy policy expert Daren Bakst expressed disappointment at the missed opportunity:
"It is disappointing that the Supreme Court declined to issue a stay on the EPA's new power plant rule.
"Like with the Obama's administration's Clean Power Plan, the EPA is trying to play national electricity grid manager, exceeding both its authority and expertise. The rule is an effort to kill off coal and reliable electricity generation. And just like with the Clean Power Plan, the Supreme Court will almost certainly shoot down the rule if it gets the chance."
