Compensation regulations for damages caused to the life or health of servicemen also to apply to the servicemen of the Patrol Service during the RA Defense

It is proposed also to spread the regulations on the servicemen of the RA state defense service for damages caused to the life or health of servicemen by the draft.

The format of the beneficiaries is stipulated by the law On Compensation for damages caused to the life or health of servicemen during the RA Defense: those are the servicemen whose life or health was damaged while participating in combat operations or during combat duty or performing a special task on the contact line with the adversary or as a result of the adversary's pre-offensive actions.

According to the law, servicemen are considered the servicemen of the RA Armed Forces and other troops. The Patrol Service is also classified in line with other troops. The Patrol Service servicemen, being involved during the war and the martial law in the armed forces, can take part in the combat operations, and perform combat duty on the contact line with the adversary and carry out special assignment.

According to the order of the compensation payment, the RA Ministries of Defense, Internal Affairs and the National Security Service (NSS) should present the necessary information on the beneficiaries.

According to the Deputy Head of the RA State Petrol Service Grigor Arakelyan, before separating from the NSS the provisions of the law were also spread on the servicemen of the Patrol Service, and in case of the compensation necessity, the abovementioned information fund should be submitted by the NSS. However, taking into consideration, the Patrol Service is no more included in the NSS structure and is a body subordinate to the Prime Minister, in line with the enumerated departments the absence of the Patrol Service can impede the beneficiaries' compensation payment, if it is necessary, and the addendum being proposed by draft is conditioned by it.

According to the rapporteur, the initiative was agreed with the concerned bodies and approved at the sitting of the Government on August 8, 2024.

The NA Expertise and Analytical Department presented two proposals on the draft, which were accepted.

The co-rapporteur, deputy Kristine Poghosyan emphasized the initiative and called on her colleagues to endorse.

The draft law On Compensation for damages caused to the life or health of servicemen during the RA Defense was debated at the sitting of the Standing Committee on Defense and Security on September 27 and was endorsed.
