Statewide - Notice of Emergency Adoption and Proposed Rule Making to amend 6 NYCRR Part 10, Sportfishing Regulations, and Part 40, Marine Fish. (Atlantic Striped Bass)

Public Notice

Pursuant to the Environmental Conservation Law sections 11-0303, 13-0105, and 13-0339, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

NYS DEC Division of Marine Resources (DMR) is filing a Notice of Emergency Adoption and Proposed Rule Making to amend 6 NYCRR Part 10, Sportfishing Regulations, and Part 40, Marine Fish. (Atlantic Striped Bass).

The emergency rule amends the recreational slot size for Atlantic Striped Bass in the Hudson River and tributaries north of the George Washington Bridge and all inland waters, from 18 to 28 inches to 23 to 28 inches. The rule also adds certain requirements related to filleting of striped bass in inland and marine and coastal waters. These changes are required by the Atlantic States Marine Fisheries Commission (ASMFC) fishery management plan (FMP) for Atlantic Striped Bass. Failure to maintain compliance with the ASMFC FMP may result in federal closure of New York's Atlantic Striped Bass fishery.

This notice will be published in issue 21 of the State Register, dated May 22, 2024.
