Notice of Utility Application to Discontinue Service

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on July 3, 2024, Ninilchik Water and Sewer Association (NINILCHIK), which holds Provisional Certificate of Public Convenience of Necessity (Provisional Certificate) Nos. 6096 (Water) and 6097 (Sewer), requested the Commission revoke Provisional Certificate No. 6097. As the matter relates to Provisional Certification, the Commission initially opened Docket No. W-24-013 to review the filing. The Commission has since construed the filing as an application to discontinue service and opened Docket No. U-24-027 to address the application.

According to NINILCHIK, it never constructed the planned sewer system for which Provisional Certificate No. 6097 was obtained. AS 42.05.261(a) provides that a public utility may not discontinue or abandon service unless, after notice and an opportunity for hearing, the Commission finds that continued service is not required by the public convenience and necessity.
