Village of Tivoli Adoption of Local Law A 1 (Proposed) of 2024

Negative Declaration

Dutchess County - The Village of Tivoli Board of Trustees, as lead agency, has determined that the proposed Adoption of Local Law A-1of 2024 will not have a significant adverse environmental impact. The action involves the adoption of a local law to regulate short-term rentals (STRs) and authorize accessory dwelling units (ADUs) in the Village of Tivoli. The law will regulate STRs to minimize impacts of this use on housing availability and affordability by prohibiting unhosted STRs in the Village. It will allow hosted STRs subject to issuance of an annual operating permit to ensure they comply with applicable codes and safety measures to discourage unsafe structures from being rented. The law will amend the Zoning Law to allow ADUs to encourage the creation of more affordable housing in the Village. It will also amend the Zoning Law to require consideration of a project's consistency with the requirements of the Americans with Disabilities Act during site plan review. The amendments are designed to protect the public health, safety, and welfare. They are consistent with the recommendations of the Greenway Compact Program and Guides to strengthen Village Centers, and with the recommendations of the Village's Comprehensive Plan to encourage appropriate levels of tourism while protecting the community's residential neighborhoods and ensuring the availability of affordable housing. The project is located throughout the Village of Tivoli, New York.
