City of Mesquite files lawsuit against Tradewind Apartments

After repeated attempts to obtain improved building conditions that meet code, the City of Mesquite commenced legal proceedings against the owner and operator of Tradewind Apartments, located at 2136 Tradewind Dr.

For most of the year, residents of the complex have intermittently experienced a lack of proper heat during winter months, air conditioning in summer months, hot water year-round and other adverse conditions.

While the City has repeatedly engaged with the operator to develop long-term solutions to these problems, recent incidents leaving residents without air conditioning during the summer heat and no management staff at the complex compelled the City to take this action.

"The City expects all landlords to provide safe and sanitary conditions for all tenants," stated City Manager Cliff Keheley. "The action taken by the City is a necessary next step to seek improved living conditions for the residents at the Tradewind Apartments."

The Tradewind Apartments are owned by the Texas Workforce Housing Foundation, which is a public facility corporation created by the SH130 Municipal Management District located in Travis County, Texas, and operated by Residence at Tradewind Apartments.

The legal action taken by the City is authorized by Texas Local Government Code Chapter 54 which permits the City to seek injunctive relief from the court for owners and operators of businesses with conditions that create a substantial danger of injury or adverse health impact and recovery of civil penalties.
